1. Who you are agreeing with

Sky Clock is made and published by Eric Rosenbaum, an independent developer ("we", "us"), on the App Store under the name Sam Harper. These terms are an agreement between you and us covering your use of the Sky Clock app and the skyclockapp.com website. By downloading or using the app, you agree to them. If you do not agree, please do not use the app.

2. Apple's terms also apply

Sky Clock is distributed through the App Store, so Apple's Licensed Application End User License Agreement applies to your use of the app in addition to these terms. Where the two genuinely conflict, Apple's agreement governs your licence to use the app. Apple is not a party to this agreement, and is not responsible for the app or for supporting it. You and we both acknowledge that Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

3. Your licence

We grant you a personal, non-transferable, non-exclusive licence to use Sky Clock on Apple devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, sell, rent, sub-license, reverse engineer or attempt to extract the source code of the app, except to the extent that the law expressly says you may despite this restriction. The app, its design, its name and its content remain ours.

4. What is free and what is paid

The sky view, the star and constellation chart, live planet and Moon positions, and the next Space Station pass are free, with no advertising. Sky Clock Plus is an optional subscription that adds tonight's timeline, the seven night forecast, alerts and the observation log.

5. Sky Clock Plus subscriptions

• Plans. Plus is offered yearly at $44.99 and monthly at $6.99. Prices are in US dollars, are shown in your local currency in the app before you buy, and may vary by region. We may change prices in future; a change never affects a period you have already paid for, and Apple will tell you before an increase takes effect.
• Free trial. The yearly plan includes a 14 day free trial for customers who have not used it before. Unless you cancel at least 24 hours before the trial ends, it converts into a paid year automatically. The monthly plan has no trial. Any unused part of a free trial is forfeited if you buy a subscription before it ends.
• Billing and renewal. Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically at the same price unless you cancel at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours of the end of that period.
• Cancelling. You can cancel at any time in your Apple Account settings, under Subscriptions. Cancelling stops the next renewal; Plus stays active until the end of the period you have already paid for. Deleting the app does not cancel a subscription.
• Refunds. Purchases are handled by Apple, so refunds are Apple's to give. Request one at reportaproblem.apple.com. We cannot issue refunds ourselves, though we are happy to help you sort out a problem.
• If Plus changes. We may add to, change or retire Plus features over time. If we ever remove something substantial that you are paying for, you may cancel, and you can ask Apple for a refund of the unused part of your term.

6. Accuracy, and what not to rely on

Sky Clock computes positions on your device using standard astronomical algorithms, checked against JPL Horizons, and predicts satellite passes using the SGP4 model from public orbital data. We work hard to make it accurate and to be open about where it is least certain.

Even so, predictions are predictions. Weather forecasts are supplied by third parties and are often wrong. Orbital data ages, and satellite manoeuvres are not announced in advance. Compass and location readings depend on your device's hardware and surroundings. Sky Clock is for interest and recreation. It must not be relied on for navigation, for aviation or marine use, for surveying, or for any purpose where being wrong could hurt someone or cost money.

7. Going outside

Stargazing means being outdoors, often in the dark and sometimes far from other people. You are responsible for your own safety: where you go, whether you have permission to be there, the weather, the terrain, and getting home. Never use the app while driving. Never point the app, or any optical instrument, at the Sun.

8. Acceptable use

Please do not use Sky Clock to break the law, to interfere with the app or its infrastructure, or to scrape, resell or redistribute its data or content. Do not upload anything to your observation log that you do not have the right to keep there.

9. Your content

Notes and photos you add to your observation log are yours. They are stored on your device and in your own private iCloud database. We do not have access to them, we claim no rights over them, and we cannot recover them for you if you lose them. Keeping your own backups is a good idea; see the Privacy Policy for how this data is handled.

10. No warranty

The app and this website are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the app will be uninterrupted, error-free, or that its predictions will prove correct. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of your use of Sky Clock. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us for it in the twelve months before the claim, or twenty-five US dollars. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Ending this agreement

You may stop using Sky Clock at any time by deleting it, remembering to cancel any subscription separately through Apple. We may suspend or end your licence if you materially breach these terms. Sections that by their nature should survive — licence restrictions, disclaimers, limitation of liability and governing law — continue to apply after this agreement ends.

13. Changes to these terms

We may update these terms as the app changes. The current version always lives on this page, with the date at the top. Material changes will be noted in the app's release notes. Continuing to use Sky Clock after a change means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the State of New York, United States, without regard to its conflict of law rules. You and we agree that the state and federal courts located in New York County, New York have exclusive jurisdiction over any dispute arising out of them. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer laws in the country where you live, or of the right to bring proceedings there.

15. General

If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing something straight away does not waive our right to enforce it later. You may not transfer your rights under these terms; we may transfer ours if the app changes hands, on notice. These terms, together with the Privacy Policy and Apple's agreements, are the whole agreement between us about Sky Clock.
